Understanding online business copyrights is one of the first and most important things that any online business owner needs to do.

Many business owners face copyright problems at some stage due to the fact that they did not take the time to understand everything about it first.

This could be that either they have violated somebody else?s rights on their website or somebody else has violated theirs.

Copyrights can sound a little bit daunting to understand at first but the principles are very straight forward.

Who Owns It?

The same applies to both online and offline businesses and publications. If somebody takes the time to create something then that is theirs and theirs alone unless they grant permission for others to use that work. If an online business writes up some content for their website but then finds it being used somewhere else without permission then this could lead to a legal claim being taken.

What to do Next

Copyright violations should never be taken straight to court. If a businesses content is found on another website without any permission being granted, then the first step is to email the owner of the website clearly stating the violation and asking for removal of the content. This will usually work straight away as the website owner would not have understood copyright laws before taking the content.

If for any reason they fail to remove the offending content then matters need to be made more formally. Legal letters can be written up by an attorney. Although this will cost money it will usually work straight away and the content will be removed and once again become the owners.

Take Down Notice

Under the US law, somebody can serve what is called a take down notice. This wouldn?t go straight to the website owner but instead it would be served to the hosting company of their website. In response to this being served, the content MUST be removed. The hosting provider may even decide to suspend the account until everything has been sorted.

If All Else Fails

Taking matters through the courts should always be the very last resort. If everything else has failed and the offending content has still not been removed then this is definitely the best bet. This can provide the owner of the content expenses and damages due to the abuse of their rights.

If it is the other way around and the online business is the offender themselves then the best way to deal with the problem is to simply remove the offending content that is said to be claimed by somebody else. No business wants a bad name and this will happen if the content is not removed and the content owner takes the business owner to court.

The problem is that when beginning in online business, the owners do so much research on certain people and then without realizing actually start writing like them. Without knowing, that same business owner may end up writing content that closely resembles another and this is what causes quite a lot of copyright offences.
